Knightly’s Terms of Service

By paying for a commission, you acknowledge that you have read and agreed to the following Terms of Service.
Ignorance of any information contained within the following terms of service will not excuse you from liability.

1. Contact

To commission me you must communicate with me directly through my email – [email protected]

Or through private notes (PM / DM) on Furaffinity (FA) via my account KnightsEternal – https://www.furaffinity.net/user/knightseternal

I only discuss commissions through these two routes.

No shouts, journal replies, or social media inquiries please, as I may or may not see them.
If I do happen to see them I will always direct you back to the aforementioned routes.
I do not discuss commissions via Discord, Telegram, or any other unspecified site at this time.

Please be wary of any “alternative accounts” claiming otherwise as they are almost certainly not me.

If any of this changes at any time, the information will be updated here before any policy changes go in to effect.

If a client fails to respond in a timely / reasonable manner and provides no warning of absence, I will drop and refund the commission. 

I simply can’t work if I don’t have the information I need. How long I wait is up to my discretion (1-4 weeks MAX) and will depend on my schedule.

2. Terms of Your Commission

  ALL terms of your commission will be worked out before any payment.
Both parties will understand and have agreed to the exact price and time estimate, have exchanged and approved reference images, and discussed any other important details of your commission before I accept any payment.
This mutual agreement will serve as our written contract.
Paying for your commission enters you into that contract and confirms that you agree to be bound by these terms of service.
I as the artist am then bound to honor our agreement, and will complete the commissioned work to the agreed specifications.
  TIMEFRAME Please note I take an average of 2-3 weeks to complete a commission.
Smaller pieces may take days, exceptionally large commissions or projects that involve slower communication may extend up to a month or more.
  WORKS IN PROGRESS “WIPs” may be requested, though not in excess. I will allow up to 2 requests for works in progress, per piece.
(I update people all the time unprompted so this really shouldn’t be an issue.)

3. Payment

 Once we have agreed to the terms of your commission, you will receive an invoice that acts as a receipt for your purchase and details what you’re paying for. This ensures no extra fees, currency exchange problems, or miscommunications.
 I will not begin working on any commission until I have received the full payment.
 Commissions will almost always be completed in the order they are paid for. If no payment is sent, the commission will not be started.
I may or may not hold on to your commission information depending on the length of time I’m waiting.
 If you expect any difficulties with payment or if special circumstances arise on your end, I am happy to try and accommodate your needs as long as I know your situation!
 PAYMENT PLANS may be available (at my discretion) for commissions exceeding $200.
Payment plans are prioritized for people I know personally and returning customers, because indecision back-outs are always a risk and I prefer to play it safe. I am however flexible depending on the circumstance, so please feel free to inquire.
  ACCEPTED PAYMENT METHODS I accept payment in $USD (U.S. Dollars) via the following Payment processors only.
(Currently shopping around for some quality alternatives.)

4. References

  I can not / will not be held responsible for errors made due to inaccurate reference material or descriptions,
nor for misinterpreting unclear / conflicting reference images.
If the references or information provided to me were “not up to date”, “missing details”, etc. and you do not let me know up front,
I will not make an edit without an appropriate fee. I’m reasonable about this; if it’s something small like a single earring I’ll let it slide,
but please make sure all the information and references you give me are accurate.
  You do not need a full ref-sheet to commission me; one or two full body or otherwise relevant images are just fine.
I will happily work off of other commissioned images of your character.
Unless your commission is “complete artistic freedom” I will require references or detailed descriptions of any character/s you want included,
as well as any other critically important clothing, props, items, environments etc.
(Any really specific details you don’t want to to leave up me.)
I am happy to work off of text-only descriptions in the case of design-work, but all other commission types require some form of visual reference.
  Please make sure you have permission to use any “borrowed” or “found” images (especially from other artists / designers)
that you want me to heavily reference, IF they do not already belong to you.
I cannot accept images of other people’s characters, nor can I copy / heavily reference characters / materials you do not own the copyright to for any type of commission. I may ask for proof of permission if I have concerns.
  Please do not bombard me with references.
Very few images (even full multiple character scenes) will ever require more than 3-4 references to get the idea across. 
 If you feel like you need to give me more than 5 reference images, please combine them into a mood board or other easy-to-view format so I can see everything in one place.
In this case, use a bright color to circle or highlight important details like “Use the feet from this image” or “Use these markings instead of the others.” 
Please use your best judgement here. And before you send refs, ask yourself (1) Will it help? (2) Does it show something important? (3) Is it necessary?
I may refuse your commission if you send an excessive number of references or have too many inconsistent / conflicting references for the same character!

5. Edits / Alterations

  I am perfectly happy to make edits or alterations for you.
If you want to change some colors, add some piercings, move small things around, or fix a missed detail, that’s completely fine!
However, please make me aware of any changes you would like EARLY, ideally in the sketch stage or at any of the points I ask you to check it.
If you need any kind of edit made (big or small) please let me know as soon as possible!
The sooner I know the easier it is to make your desired change.
  I give commissioners several opportunities throughout the commission process to request changes before continuing on to the next stage.
Please sum up what you would like changed all at once so we can save the time and effort it would take for you to check tons of tiny edits one at a time.
I am happy to work with you, and I don’t mind making edits. Your happiness is my main concern.
  If you want big changes made, lots of things moved around, or a large alteration that was not specified at the beginning,
I may require an appropriate fee. I will allow up to 2 free medium changes / edits per piece (at my discretion.)
Every edit after the original 2 free edits will cost a minimum of an additional $5 USD.
  Multiple Character Commissions and Gifts
If multiple people are involved in a commission, please check each step of the commission process with any involved person/s BEFORE approving each stage. For example: the recipient of a gift art piece, or another person you split the cost of a commission with.
Please be careful about this! If you approve a stage THEN show the recipient who wants changes made, it is already too late and I will only make edits for an extra fee.
I will not make edits after the final art file has been finished / approved / delivered!
  SURPRISE GIFTS
If you are ordering a present for a someone you know that involves their character, they MUST be aware that you are getting something for them.
I will not knowingly paint “surprises” for unknowing recipients without their permission.
I will require written consent from all character owners for extreme NSFW pieces!
Absolutely no “Extreme NSFW Surprise gifts” (that’s just asking for trouble.)
Generally I don’t care to make gift-style artwork for people I’m not communicating directly with;
it can be a difficult game of telephone trying to keep several people on the same page.
I can not / will not be held responsible if the recipient of a surprise gift work (that they have never seen) does not like details or end result of any given piece after I have followed your instructions and had each stage approved.
  DRASTIC CHANGES / EDITING like complete re-draws, pose changes, or changes of character will never ever be free.
If I am halfway through your piece and you suddenly decide you want a drastic change or alteration, you have two options:
(1) If you no longer want the piece I’ve been working on, you may request a partial refund.
Please note that I require 50% of the total cost of the commission as a non-refundable creation fee.
(2) If you would like me to continue the piece and make your desired large changes, I will require an appropriate fee to compensate for my time and effort in drawing the changes. 
If you order a pizza and then suddenly decide you’d rather have a cheeseburger, you still have to pay the pizza man for his efforts.
By ordering the pizza, you entered into an agreement to pay for your pizza the same way you agreed to pay an artist for the commission you ordered.
By paying me for your commission, you are contracting me to draw exactly what you ordered; therefore, big edits will always be extra because it’s not easy to change a pizza into a cheeseburger. 

6. Refunds / Delays

  If you are not satisfied with the work / product you received, please let me know; I will do my absolute best to accommodate you, and help turn the situation into a positive and happy one for both sides! 
Please remember that I will ask for your approval at several stages during the creation process.
Therefore I can only reasonably refund the work that you have not already approved. 
➤   If you decide you would like a cash refund, I will be happy to refund up to a maximum of 50% of the total commission cost.
The other half is non-refundable as it goes towards time / effort/ materials used to create the commission.
  There are NO refunds on completed work.
As we all know, life happens. If something comes up on my side (for example, a medical or family issue that renders me unable to work on commissions) you have two choices. 
You may either keep your place and wait for the issue to be resolved, or you may receive a full refund.
If you have problems on your side, please just let me know. As long as things stay calm, reasonable, and relaxed, I will happily work with you!

7. Image Rights

  I reserve the right to use any image I create as I see fit; I retain all rights to the image.
This includes but is not limited to using images in portfolios or examples, posting to my online galleries, or creating and selling prints / products of images.
I may repurpose unused sketches, thumbnails, or other materials that were used in the creation of your commission
(for example: alt-sketches or thumbnail compositions you rejected in favor of another.)
  ALL RIGHTS RESERVED I retain full commercial and distribution rights of any image I produce unless said rights are purchased by the client.
HOWEVER! Please let it be known that I will never make products of your OC or Fursona; I find that practice extremely scummy and don’t ever intend to do it.
I may use them as examples for gallery work or commissions, but I will never ever sell them.
The characters you create are yours and I will not infringe on your (or the character designer’s) creative rights.
If I have any questions I will likely ask you for permission first.
The image or product I create for you is for you to use personally anywhere you like.
You are welcome to post it or do anything you would like with it as long as you give credit.
Again PERSONAL USE.
  YOU MAY NOT
Claim it as your own work, use it for any commercial purposes, drastically edit the image without my permission, or alter my signature in any way!!
You may not trace and re-post my work in any way, shape, or form.
You may not use any of the material I create for you to mint or otherwise produce cryptocurrency including but not limited to NFTs
(Non-fungible Tokens). 
You may not “feed” upload, or otherwise insert any of the material I create for you into AI (artificial intelligence) or any similar programs in any form or for any reason.
If you have specific questions about these rules please ask. 
  PURCHASING COMMERCIAL RIGHTS
If you would like to purchase commercial / distribution rights to a commission, or to an image that has already been created, please contact me.
On average full image rights range from 2-5 times the regular image cost, depending on the type of commission, who’s buying it, and the intended use (cheaper for Indie-creators.)
Full image rights for something like a sticker will be priced very differently than for a full illustration. Images you purchase in full will not contain any watermarks or signatures (unless you specifically want them included.)
Once you have purchased the full image rights you no longer need to credit me, and you are welcome to do absolutely anything you want with it.
At that point it belongs to you and is completely out of my hands.
  If you intend to use your commissioned image for commercial purposes such as a logo, t-shirt design, surface pattern, sticker, or any other printed and / or digital product with the intent of selling or re-distributing beyond personal use, you MUST make it known to me in your initial commission request
(this is so that any transfer of rights can be made known in your commission contract from the start.)
If you did not purchase commercial use or other distribution rights from me, then you do not own those rights.
I retain the copyright on any images I create; your characters belong to you, the finished work belongs to me.
  ADOPTABLES AND CUSTOM DESIGN WORK
Adoptables, characters, or other designs purchased from me are not to be resold for more than they were originally purchased
(with the exception of the cost of extra art, or if you purchased the full rights to the design.) 
Any transactions, claims, re-sells, etc. are the commissioner’s responsibility the moment I transfer the design files, so please be mindful and keep your high quality / unwatermarked images safe!
I significantly reduce the file sizes and watermark all images I post publicly, so I will not be the source of any HQ image leaks.
I will not be held accountable or responsible in any way for any loss, theft, or other damages to the design once the digital files have been transferred to you.
At no point will I accept refunds for adoptables or any other type of design-work after the digital files have been transferred.

8. Privacy

  If you wish to remain anonymous as the commissioner of any image or product, please let me know upfront!
If you wish to remain anonymous as the commissioner (but I can still post the image), there is no fee.
  If for some reason you absolutely do not want images of your commission posted anywhere, please let me know upfront!
I REQUIRE A NO-POSTING FEE FOR 100% PRIVATE IMAGES
If I am not allowed to share or post the image to any of my galleries, I triple the cost as a “privacy fee”. 
That is triple the total cost of your commission, paid up-front, nonrefundable (a private commission that costs $100 up front will cost $300 with the added privacy fee.)
Private commissions of this type are completely unwatermarked and require no credit back to me; you will receive the full image rights as compensation for the increased cost.
  One of the best tools for growth as an artist is word of mouth / exposure through networking.
If I take a commission that I can’t post anywhere and no one can see it, it doesn’t benefit my growth.
I’ve suddenly done a lot of work that I can’t share and won’t benefit the expansion of my artistic platform, therefore I might as well sell you the full rights.
This is a problem that adds up over time, and an exclusivity fee is the only fair way I can think to address it because I’m in the fairly early stages of networking.
I need all the free exposure from posting I can get at this point, and I already have more than 10 fully painted images I can’t post anywhere.
If you ever wonder why I’ve posted so little “extreme content,” this is why. It’s a lot of invisible work and it adds up!
I apologize for any inconvenience! Again, this fee is the only fair way I can think of to find a good middle ground between artist and commissioner comfort.
I want to be able to share what I make for you with other people who love the same stuff!
(And I’m always extremely grateful to commissioners who generously contribute to my artistic growth in this way.)
  Delayed posting for gift pieces (Like birthday or Christmas presents) will have no fees.

9. Refusal of Service

  I reserve the right to refuse service to anyone for any reason.
  You must be 18 years or older to commission me.
I will NOT create pornographic material for minors; I will likely check or ask for your age beforehand if I have any concerns.
By purchasing pornographic / nude (or any other form of material that could be considered adult in nature)
you acknowledge that you are at least 18 years of age. 
  I will NOT create pornographic material depicting minors, or any character I believe to be underage.
  I may or may not check your background / profile if I have concerns about offering you any of my services. 
  I may refuse you service if I find that other artists have had trouble working with you in the past.
  I may refuse or terminate service for any form of suspicious or questionable behavior. 
  I avoid suspicious profiles and accounts that are recently opened or appear empty.
  I can and will refuse you service for rude or inappropriate behavior.
You may also receive a block / blacklist and / or a report from any / all of my online spaces.
  I will reject your commission request if I can not understand you, or if you are not able to communicate in clear English.
(So no role-play speak, “UWU” or “heavy euphemism” etc.)
  Please be open and respectful – I am here to work with you. I want you to be happy with the work you receive as well as your commission experience!
